Thug jailed for bashing WWII over 50c By Bryon Kaye The Daily Telegraph March 07, 2009 12:01am THE thug who bashed an elderly World War II veteran for 50c cried "f**king bullsh*t" yesterday as he was jailed for two years for his gutless crime. Kristopher Cowie, 30, also punched the wall of the dock in Sutherland Local Court as a magistrate said the community was right to be outraged by his senseless attack. The drug addict, already in jail for another violent outburst, then wrestled with court officers to touch his girlfriend, Tracey Prater, who witnessed the attack, before being led away. Ernie Evans was 83 when Cowie repeatedly punched him in the face, knocking him to the ground, at a bus stop in Caringbah in October last year. The court heard Cowie was angered when he asked Mr Evans for 50c and the old man told him to "get a job". Mr Evans suffered serious leg injuries but died of a heart attack six weeks later, a tragedy his family said was brought on by trauma associated with the bashing. "It must have been clear to Mr Cowie that the victim of this assault was elderly and frail," Magistrate Clare Farnan told the court. "The community is rightly concerned to show its disapproval of behaviour of this sort." Her sentencing remarks suggest little sympathy for Cowie, who had complained he was being victimised in jail by inmates and even prison guards because of the crime. Cowie is already serving a one-year sentence - in protective custody because of the assaults - for threatening to kill a security guard at an airport. His lawyer Sean Brennan argued his client never planned to attack anyone and hearing Mr Evans' comment "felt he had some honour to protect". "He (Cowie) was the one who had no dignity in having to ask for 50c," Mr Brennan said. Ms Farnan said the offender had shown no remorse and clearly needed help with "aggression and impulse control" shortly before his outburst. Cowie's sentence for bashing Mr Evans, with 15 months non-parole, starts after his current term expires on January 20 next year - the 82nd birthday of Mr Evans' widow Una. "I couldn't hope for a better birthday present," Mrs Evans said outside court before celebrating with a cup of tea. "Justice has been done. Assumed self "Dignity" seems to me the furthest portion of this heinious crime, the fact the perpetator had no self-worth is not the problem of the victim. If he had been "worth" something to society he would have had "dignity", both expressed and earned. He had neither. The widow was right, this fellow doesn't belong in a society. Our own (American) is sometimes very disturbing as per our respect to our elderly, and many violent assaults have taken place over the years. But, that said I don't recall one over a 50c incedent. Perhaps it was the "get a job" that threw this into silly, but the convicted man's actions post trial seem to imply he never could accept his own failings, and resented having them calle to the fore.
